Diritto di recesso
In cosa consiste?
L’utente, consumatore, in conformità al Decreto Legislativo del 6 Settembre 2005 n. 206 (Codice del consumo, a norma dell’art. 7 della legge 29 Luglio 2003, n. 229) ha diritto di recedere da qualunque contratto a distanza, senza alcuna penalità e senza specificarne il motivo, entro il termine di 10 giorni lavorativi dal ricevimento della merce.

Libreria Libr'Aria garantisce il diritto di recedere in conformità al Decreto Legislativo del 6 Settembre 2005, n. 206

Il diritto di recesso è comunque sottoposto alle seguenti condizioni:
· il bene acquistato dovrà essere reso nelle condizioni in cui è stato ricevuto;
· al suo arrivo in magazzino la merce verrà esaminata per valutare eventuali mancanze, danni o manomissioni pertanto, raccomandiamo la massima attenzione nel preparare il pacco e consigliamo di riutilizzare gli imballi originali. La sostanziale integrità del bene restituito è condizione essenziale per l’esercizio del diritto di recesso.
· I costi di restituzione non sono oggetto di rimborso (art. 67, comma 3, Decr. Lgs. n. 206 del 2005)
· Nelle operazioni a premi o campagne promozionali in cui l’acquisto di un bene è abbinato ad un altro bene che viene venduto ad un prezzo irrisorio o addirittura regalato, se non diversamente indicato, il diritto di recesso sarà legittimamente esercitato con la restituzione di entrambi i beni oggetto dell’acquisto, stante il vincolo dell’accessorietà del bene in promozione rispetto al primo.

Cosa fare alla consegna della merce?
All’arrivo della merce ti consigliamo di verificare che:
· L’imballo risulti integro, non danneggiato né bagnato o altrimenti alterato
· I prodotti contenuti corrispondano a quelli indicati nella fattura accompagnatoria che viene sempre emessa con l’invio dell’ordine.

Eventuali danni all’imballo, devono essere immediatamente contestati al vettore e tempestivamente segnalati al nostro Servizio Clienti ( Customer Care )

Eventuali non corrispondenze fra il contenuto dell’imballo e quanto riportato in fattura devono anch’esse essere segnalate al nostro Servizio Clienti ( Customer Care )

Come esercitare il diritto di recesso?
Per esercitare tale diritto è necessario darne comunicazione a mezzo lettera Raccomandata A.R. entro 10 (dieci) giorni lavorativi dalla data di ricevimento della merce. Come previsto dall’ art.64, comma 2, del D.Lgs. n.206 del 6/09/2005 tale comunicazione potrà essere anticipata anche via fax, telegramma e posta elettronica a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le 48 ore successive. Nella comunicazione, oltre gli estremi dell’acquisto (data e numero fattura), dovrà essere indicato quali prodotti sono oggetto di recesso, nonché le coordinate bancarie sulle quali ottenere il bonifico. Entro 48 ore dall’attivazione della pratica di recesso riceverete una e-mail da parte del customer care di Libreria Libr'Aria con il CODICE DI RECESSO e le modalità di spedizione. Applicare sul pacco il codice di recesso in modo ben visibile ed, entro 10 (dieci) giorni lavorativi dal ricevimento del codice di recesso, effettuare la spedizione al seguente indirizzo:

Le spese di restituzione della merce sono a carico di chi esercita il diritto di recesso (vedi art. 67, comma 3, D.Lgs. n. 206 del 2005). Antica Libreria S.r.l si riserva il diritto di rifiutare la merce pervenuta nell’ipotesi di mancato rispetto della procedura sopra indicata o che gli imballi non risultino idonei al trasporto della merce.

In quanto tempo viene effettuato il bonifico per il reso?
In conformità a quanto previsto dal citato D.Lgs. n. 206 esso avverrà entro 30 giorni dal ricevimento della raccomandata di comunicazione di reso e comunque non prima del ricevimento della merce e successiva verifica ed accettazione dell’integrità dei prodotti da parte di Libreria Libr'Aria.
Libreria Libr'Aria provvederà, quindi, ad effettuare l’accredito al cliente per l’importo corrispondente al valore della merce, così come risultante dalla fattura. Le spese di restituzione non saranno oggetto di rimborso; le spese di spedizione saranno rimborsate solo nel caso di reso di tutta la merce acquistata.
